85. (1) A sweeper employed by a Municipality who, - (a) except in accordance with the terms of a written contract of service, or with the permission of the Municipality, resigns or abandons his employment, or (b) without a reasonable cause of which notice has, when possible, been given to the Municipality, absents himself from his duties, shall be liable upon conviction to imprisonment which may extend to two months. (2) The 1[Prescribed Authority] may direct that on and from specified future date the provisions of sub-section (1) shall apply also to any other specified class of servants employed by a Municipality whose functions intimately concern the public health or safety : Provided that when a 1[Prescribed Authority] makes an order under this sub-section he shall forthwith forward a copy thereof, with a statement of his reasons for making it, to the 2[State Government] which may thereupon rescind the order or direct that it continue in force, with or without modification, permanently or for such period as it thinks fit.
