36. (1) In case of emergency the District Magistrate may 1[with the permission of the Prescribed Authority] provide for the execution of any work or the doing of any Act which the municipal Municipality is empowered to execute or do and of which the immediate execution or doing is, in his opinion, necessary for the safety or protection of the public and may direct that the expense of executing the work or doing the act shall be forthwith paid by the Municipality. (2) If the expense is not so paid the District Magistrate may make an order directing the person having the custody of the municipal fund to pay the expense from such fund. (3) The District Magistrate shall forthwith report to the [Prescribed Authority] every case in which he uses the powers conferred on him by this section.
