Functions of a Municipality that must be discharged by the executive

§60

Summary

1[60. (1) In any municipality where there is an executive officer the following powers of the Municipality shall be exercised by such officer, and save as provided in section 62, not otherwise, namely- (a) the power to grant and issue under his signature or to refuse any license which can be granted by a Municipality, other than a license for a market, slaughterhouse or hackney carriage ; (b) the power to suspend or withdraw any such license ; (c) the power to receive, recover and credit to the municipal fund any sum due or tendered to the Municipality ; (d) the powers conferred by the section or sub-sections specified in the first column or schedule II [or where such sections or subsections are followed by the words "in part" by such parts thereof as are indicated by the description in column 2 of the said schedule]2 and the power to do all things necessary for the exercise of these powers ; (e) in respect of servants of the Municipality, the powers vested in the executive officer by sections 75 and 76, and the power to grant leave of absence to the holder of any post to which he has power to appoint. (f) any other power that has been delegated by the board to the executive officer. 3[(2) 4[ * * * * ] All servants of the Municipality shall be subordinate to the executive officer.
