[39. If a member of a Municipality other than the President resigns by writing under his hand addressed to the [State Government]1 his seat shall thereupon become vacant. The resignation shall be delivered at the office of the District Magistrate of the district, in which the municipality is situate who shall forthwith inform the President and shall forward the resignation to 1(State Government) ]2
