Compensation when payable

<span style="margin-left:15px;"></span><span style="margin-left:15px;"></span>(1) Where any land vests in the Board under section 30 and the Board makes a declaration that such land shall be retained by the Board until it re-vests in the Gaon Sabha or the local authority concerned as part of a street or an open space under section 34, no compensation shall be payble by the Board in respect of such land.<br> <span style="margin-left:15px;"></span><span style="margin-left:15px;"></span>(2) Where any land vests in the Board under section 30 and no declaration is made under sub-section (1) in respect of the land, the Board shall pay to the Gaon Sabha or the local authority concerned a sum equal to the market value of the land as compensation.<br> <span style="margin-left:15px;"></span><span style="margin-left:15px;"></span>(3) Where the Board has made a declaration in respect of any land under subsection (1) and the Board detains or disposes of the land contrary to the terms of the declaration so that the land does not re-vest in the Gaon Sabha or other local authority, the Board shall pay compensation in accordance with the provisions of sub-section (2).<br>
