Summary

98. (1) No vacancy in a 1[Zila Panchayat] or in a committee of a 1[Zila Panchayat], or a sub-committee appointed by the Karya Samiti, shall vitiate any of its acts or proceedings. (2) No disqualification or defect in the election, co-option or appointment of a person acting as a member of a 1[Zila Panchayat] or of a committee or sub-committee appointed under this Act or as the presiding officer of a meeting of a 1[Zila Panchayat] or of such committee or sub-committee, shall be deemed to vitiate any act or proceeding of the 1[Zila Panchayat], committee or sub-committee, if the majority of the persons present at the time of the act being done, or proceeding being taken were members of the 1[Zila Panchayat] or committee or subcommittee without any such disqualification or defect. (3) Until the contrary is proved any document or minutes which purport to be the record of the proceedings of a 1[Zila Panchayat], a committee or a sub-committee shall, if substantially made and signed in the manner prescribed for the making and signing of the record of such proceedings, be deemed to be a correct record of proceedings of a duty convened meeting held by a duly constituted 1[Zila Panchayat], committee or sub-committee, where of all the members were duly qualified. (4) The provisions of the preceding sub-sections shall mutatis mutandis apply to acts and proceedings of every 1[Kshettra Panchayat] or committee or sub-committee thereof.
