212. 1[(1) If any private street or part thereof is not leveled, paved, metaled, flagged, channeled, severed, drained, conserved, or lighted to the satisfaction of the Municipality, the Municipality may by notice require the owners or occupiers of 2[or lands] fronting, or abutting such street or part thereof to carry out any work which in its opinion may be necessary, and within such time as may be specified in such notice. (2) if such work is not carried out within the time specified in the notice, the Municipality may, if it thinks fit, execute it and the expenses incurred shall be recovered from the owners or occupiers in default under Chapter VI according to the frontage of their respective premises and in such proportion as may be settled by the Municipality. (3) If any, street has been leveled, paved, metaled, flagged, channeled, severed, drained, conserved and lighted under the provisions of the preceding sub-sections, such street shall, on the requisition of not less than three-fourths of the owners thereof, be declared a public street. ]
