1[33. (1) Any person, who contravenes, or fails to comply with any of the provisions of this Act, or of the rules made thereunder, other than those of sub-section (1) of section 20, shall be guilty of an offence under this Act. (2) The Inspector shall, before initiation of prosecution proceeding for the offences under this Act except sub-section (1) of Section 20, give an opportunity to the employer to comply with the provisions of the Act by way of a fifteen days written improvement notice, and, if the employer complies with the direction within such period, the Inspector shall not initiate such prosecution proceeding against the employer. No such opportunity shall be accorded to an employer, if the violation of the same nature of the sections and rules made under this Act is repeated within a period of five years from the date on which such first violation was committed; and in such case, the prosecution shall be initiated in accordance with the Act and orders issued by the State Government from time to time.] .
