10. (1) The term of office of members of the Council other than ex-officio members, shall be three years from the date of election or nomination; Provided that the term of office of a member elected or nominated under section 9 shall be the residue of the term of office of the member in whose place he was elected or nominated. 5 Provided further that where a member elected under sub-clause (ii) or (iii) of clause (b) of sub-section (1) of section (4) ceases to be a member of the Uttar Pradesh Legislative Assembly or the Uttar Pradesh Legislative Council, as the case may be, he shall cease to be a member of the Council. (2) An outgoing member, if not disqualified under section 11, shall be eligible for re-election or re-nomination.
