When a person suffering or certified by a duly qualified medical practitioner to be suffering from cholera, plague, small-pox or any other infections disease that may be notified in this behalf by the 1[State Government] is - (a) without proper lodging or an accommodation, or (b) living in a sarai or other public hostel, or (c) living in a room or house which he neither owns nor is otherwise entitled to occupy, or (d) lodged in a room or set of apartments occupied by more than one family and any of the occupiers objects to his continuing to lodge therein. the Municipality may, on the advice of a medical officer of rank not inferior to that of an assistant surgeon remove the patient to a hospital or place at which persons suffering from such disease are received for medical treatment, and may do anything necessary for such removal.
