23. For the purposes of this Chapter- 1[(a) the expression "Assembly" or "Council" shall include the United Provinces Legislative Assembly or the United Provinces Legislative Council respectively: (i) which was constituted and functioned as such under the Government of India Act, 1935, either before or after the commencement of the Indian Independence Act, 1947 ; or (ii) which functioned as a House of the provisional Legislature for the State under the Constitution of India.] (b) the expression 'year' means any period of twelve calendar months; (c) the period during which a person has, by virtue of his membership in the Assembly or Council, held any of the offices mentioned in clause (i) of section 2 shall also be taken into account for determining the term of such membership.
