(1) If any place is, in the opinion of the 1[Municipal Commissioner], from want of sufficient repair, protection or enclosure or owing too some work being carried on thereupon dangerous to passengers along a street, or to the neighborhood thereof or if any such work, in the opinion of the 1[Municipal Commissioner], affects the safety or convenience of such person, he may by notice in writing require the owner or occupier thereof to repair, protect or enclose the said place or take such other step as shall appear to the 1[Municipal Commissioner] necessary in order to prevent danger therefrom or to ensure safety or convenience of such person. (2) The 1[Municipal Commissioner] may, before giving any such notice or before the period of any such notice has expired, take such temporary measures as he thinks fit to prevent danger from the said place or to ensure safety or convenience at such work, and any expense incurred by the 1[Municipal Commissioner] in taking such temporary measure shall be paid by the owner or occupier of the place to which the said notice refers.
