Right of owners and occupiers of buildings and lands to drain into 1Corporation drains

Summary

234. (1) Subject to the other provisions of this section, the owner or occupier of any premises shall be entitled to cause his drain to empty into a 1[Corporation] drain or other place lawfully set apart for the discharge of drainage : Provided that nothing in this sub-section shall entitle any person- (a) to discharge directly or indirectly into any 1[Corporation] drain any trade effluent except in accordance with the provisions of section 240 or any liquid or other matter the discharge of which is prohibited by or under this Act or any other law for the time being in force ; (b) where separate 1[Corporation] drains are provided for foul water and for surface water to discharge directly or indirectly- (i) foul water into a drain provided for surface water ; or (ii) except with the permission of the 2[Municipal Commissioner] surface water into a drain provided for foul water ; or (c) to have his drain made to communicate directly with a storm water overflow drain. (2) Every person desirous of availing himself of the provisions of sub-section (1) shall obtain the written permission of the 2[Municipal Commissioner] and shall comply with such conditions as the 2[Municipal Commissioner] may prescribe as to the mode in which and the superintendence under which connections with 1[Corporation] drains or other places aforesaid are to be made. (3) The 2[Municipal Commissioner] may, if he thinks fit, in lieu of giving permission aforesaid under sub-section (2) himself so connect the drain or sewer after giving notice to the person concerned within fourteen days of the receipt of his application. In any case where the 2[Municipal Commissioner] proceeds under this sub-section, the reasonable expenses of any work so done shall be paid by the person aforesaid.

234.
