Purposes for which 2Corporation Fund is to be applied.

§140

Summary

140. The moneys credited to the 1[Corporation] Fund from time to time shall in the first place, be applied for payment of salaries and allowances of Safai Mazdoors and then in the following order of preference :-- Firstly, in making due provision for the repayment of all loans payable by the 1[Corporation] under the provisions of Chapter VIII ; Secondly, in discharge of all liabilities imposed on the 1[Corporation] by clause (b) of sub-section (1) of section 126 ; Thirdly, in payment of all sums, charges and costs necessary for the purposes specified in sections 114 and 115, and for otherwise carrying this Act into effect, or of which the payment shall be duly sanctioned under any of the provisions of this Act inclusive of :-- (a) the cost of auditing the 1[Corporation] accounts ; (b) the expenses of every election held under this Act ; (c) the salaries, allowances and contributions to pensions and leave salaries of the 2[Municipal Commissioner] and of any other officer whose services may at the request of the 1[Corporation] be placed by the State Government at the disposal of the 1[Corporation] ; 3[(d) the salaries and allowances of 1[Corporation] officers and servants, other than Safai Mazdoors, and all pensions, gratuities, contributions and compassionate allowances payable to all officers and servants of 1[Corporation] under the provisions of this Act ;] (e) the salaries and fees of experts for service or advice in connexion with any mater arising out of the administration or undertaking of the 1[Corporation] ; (f) all expenses and costs incurred by the 1[Corporation] or by any 1[Corporation] officer on behalf of the 1[Corporation] in the exercise of any power conferred, or the discharge of any duty imposed on it or them by this Act, including moneys which the 1[Corporation] is required or empowered to pay by way of compensation ; (g) every sum payable (i) by order of the State Government or under an award made under the Arbitration Act, 1940, or a decree or order of a civil court, as the case may be ; (ii) under a decree or order of a civil or criminal court passed against the 2[Municipal Commissioner] ; (iii) under a compromise of any suit or other legal proceeding or claim ; (h) contributions to public institutions which the State Government may, after consulting he 1[Corporation], declare to be in the interest of the inhabitants of the City. Explanation-- For the purposes of this section, a person shall deemed to be a Safai Mazdoor if he is employed by 1Corporation for the purposes of sweeping and cleaning of 1[Corporation] roads, lances, pathways, drains, sewers, latrines, and urinals, carrying of dead animals and refuge and for other jobs of the like nature.
