Transfer of any function by Zila Panchayat or Kshettra Panchayat to another local authority

§34

Summary

34. (1) Notwithstanding anything contained in this or any other law for the time being in force, but subject to the provisions of any rules made by the State Government in this behalf, a 1[Zila Panchayat] or a 1[Kshettra Panchayat] may at any time with the prior sanction of the State Government and with the consent of a 2[Gram Panchayat] or Bhumi Prabandhak Samiti existing in the district delegate to such 2[Gram Panchayat] or Bhumi Prabandhak Samiti, any of its powers or functions under this Act in respect of the area within which such 2[Gram Panchayat] 2[Gram Panchayat] or Bhumi Prabandhak Samiti exercises jurisdiction ; Provided that the 1[Zila Panchayat] or the 1[Kshettra Panchayat] may at any time with the sanction of the State Government resume any or all of the powers or functions so delegated. (2) A 1[Zila Panchayat] may similarly delegate to a 1[Kshettra Panchayat] and a 1[Kshettra Panchayat] to the 1[Zila Panchayat] any of its power or functions under this Act. (3) The State Government may at any time direct that any power or function of the 1[Zila Panchayat] shall be transferred to the 1[Kshettra Panchayat] or the 2[Gram Panchayat] in the district, that any power or function of the 1[Kshettra Panchayat] shall be transferred to the 2[Gram Pramukh] or that any power or function of the 1[Zila Panchayat] shall be transferred to the 1[Zila Panchayat] and of the 2[Gram Pramukh] to the 1[Kshettra Panchayat] or the 1[Zila Panchayat].

34.
