(1) Whoever, (a) in contravention of the provisions of this Act, the rules or the regulation made under this Act or of the provisions of the Indian Electricity Act, 1910, the Electricity (Supply) Act, 1948 or the rules made thereunder engages in the business of transmission or supply of electricity, or (b) refuses or fails without reasonable cause to comply with or give under this Act, effect to any direction, order or requirement made shall be guilty of an offence under this Act. (2) Any person guilty of offence under clause (a) of sub-section (1), shall be punished with imprisonment which may extend to six months or with fine which may extend to rupees five lakh, or with both, and a further penalty which may extend to rupees twenty thousand for each day after the first during which the offence continues. (3) Any person guilty of an offence under clause (b) of subsection (1) shall be punished with imprisonment which may extend to six months or with fine which may extend to rupees five lakh or with both and a further penalty which may extend to rupees twenty thousand for each day after the first during which the offence continues.
