(a) No Court shall take cognizance of any offence punishable under this Act, except with the previous sanction of 1[the Commissioner.] (b) No Court inferior to that of 2[a Metropolitan Magistrate] or a Magistrate of the First Class shall try any offence punishable under the Act. (c) Notwithstanding anything contained in 3[the Code of Criminal Procedures, 1973 (II of 1974)] an offence punishable under this Act shall be cognizable and bailable.
