Where any mortgaged property is in the possession of the mortgagee or his tenants other than the mortgagor and the Court is unable to determine what profits have actually been received, it may fix a fair rent for such property and charge the mortgagee such rent as profits for the purpose of section 22: Provided that, if it be proved that in any year there was any suspension or remission of rent or land revenue of such land under section 84A of the Bombay Land Revenue Code, 1879 (Bom. V of 1879), an abatement of the whole or part of such amount may be allowed for the year.
