88Power of Government and Chief Executive Officer to provide for performance of duties in default of Gram Panchayat or Zilla Parishad

When the Government in case of a Zilla Parishad and the Chief Executive Officer in case of a Gram Panchayat is informed on complaint made or otherwise, that any Zilla Parishad or Gram Panchayat has made default in performing any duty imposed on it, by or under this Act, or by or under any law for the time being in force and if the Government or Chief Executive Officer, as the case may be, is satisfied after due enquiry that any Zilla Parishad or Gram Panchayat, has failed in the performance of such duty, the Government or the Chief Executive Officer, as the case may be, may fix a period for the performance of that duty:
Provided that no such period shall be fixed unless the Zilla Parishad or Gram Panchayat concerned has been given an opportunity to show cause why such an order shall not be made.
