(1)The Chancellor, the Vice-Chancellor, the members of the Executive Council, Academic Council and others, holding office as such in university are hereby constituted by the name of the Harcourt Butler Technical University, Kanpur;(2) The University shall be a body corporate; (3) Any reference to Harcourt Butler Technological Institute, Kanpur, in any other law or in any contract or other instrument shall be constant as a reference to the University; (4) All property movable or immovable, of or belonging to Harcourt Butler Technological Institute, Kanpur shall stand taken over by the State Government from the society and transformed to the University; (5) Every person employed by Harcourt Butler Technological Institute, Kanpur, immediately before commencement of this Act, shall hold his office or service in the University, except to Director, the Deputy Director, the Registrar, the Deputy Registrar and the Assistant Registrar, on the same terms and conditions, notwithstanding anything to the contrary contained in any other provisions of this Act and unless changed, including leave, pension, gratuity provident fund etc. and other matters, as he would have held by him before the commencement of this Act, shall continue to hold as such unless and until his employment is terminated or he opts for the University's terms and conditions of employment; (6) Notwithstanding anything to the contrary contained in any other provisions of this Act, existing students of Harcourt Butler Technological Institute, Kanpur who joined courses/ programs before the commencement of this Act shall continue to pursue their academic courses and programs of study under previous dispensation, unless a specific provision is made in the Ordinances otherwise, on the recommendation of a committee duly constituted by the state government for the purpose; (7) The University shall not lease, sell or otherwise transfer or dispose off any movable or immovable property, of the University without the prior consent of the State Government.
