12. No Magistrate shall take cognizance of an offence punishable under section 10, except— (a) upon a report in writing of the facts constituting such offence made by a police officer ; or (b) upon information received from any person other than a police officer, or upon his own knowledge or suspicion, that such offence has been committed.
