(1) No Court shall take cognizance of any offence punishable under this Act, except with the previous sanction of the Metropolitan Commissioner or the Chief Executive Officer or any person authorised by the Metropolitan Commissioner or the Chief Executive Officer, by general or special order, in this behalf. (2) Notwithstanding anything contained in the Code of Criminal Procedure, 1973 (II of 1974), an offence under sub-section (1) of section 64 shall be cognizable and bailable. (3) No Court inferior to that of a Metropolitan Magistrate or a Judicial Magistrate of the first class shall try an offence punishable under this Act.
