Penalty for contravention of provisions of section 43.- Whoever in contravention of the provisions of section 43,- (a) drinks in a public place 2* ** (b)3* * * (c) serves liquor at any ceremonial or other function or any assembly of persons where persons (not being members, of his family or his employees) not holding permits under section 40, 41, 46A or 47 are present, shall, on conviction, be punished for every such offence with imprisonment which may extend to six months or with fine which may extend to 4[ten thousand rupees] or with both.].
