5. Coming into operation of Bombay Acts 1[or Maharashtra Acts.].- 2[(1) Where any Bombay Act 3[or Maharashtra Act] is not expressed to come into operation on a particular day, then, (i) in the case of a Bombay Act made before the commencement of the Constitution, it shall come into operation, if it is an Act of the Legislature, on the day on which the assent thereto of the Governor, the Governor-General or His Majesty, as the case may require, is first published in the Official Gazette and, if it is an Act of the Governor, on the day on which it is first published as an Act in the Official Gazette ; (ii) in the case of a Bombay Act 4[or Maharashtra Act] made after the commencement of the Constitution, it shall come into operation on the day on which the assent thereto of the Governor or the President, as the case may require, is first published in the Official Gazette.] (2) Unless the contrary is expressed, a Bombay Act 5[or Maharashtra Act] be construed as coming into operation immediately on the expiration of the day preceding its commencement.

Coming into operation of Bombay Acts <sup>1</sup>[or Maharashtra Acts.].</b>- <sup>2</sup>[(<i>1</i>) Where any Bombay Act <sup>3</sup>[or Maharashtra Act] is not expressed to come into operation on a particular day, then,<br> <span style="margin-left:15px;"></span><span style="margin-left:15px;"></span>(<i>i</i>) in the case of a Bombay Act made before the commencement of the Constitution, it shall come into operation, if it is an Act of the Legislature, on the day on which the assent thereto of the Governor, the Governor-General or His Majesty, as the case may require, is first published in the <i>Official Gazette</i> and, if it is an Act of the Governor, on the day on which it is first published as an Act in the <i>Official Gazette</i> ;<br> <span style="margin-left:15px;"></span><span style="margin-left:15px;"></span>(<i>ii</i>) in the case of a Bombay Act <sup>4</sup>[or Maharashtra Act] made after the commencement of the Constitution, it shall come into operation on the day on which the assent thereto of the Governor or the President, as the case may require, is first published in the <i>Official Gazette</i>.]<br> <span style="margin-left:15px;"></span>(<i>2</i>) Unless the contrary is expressed, a Bombay Act <sup>5</sup>[or Maharashtra Act] be construed as coming into operation immediately on the expiration of the day preceding its commencement. <br>
