(1) No aerial ropeway shall be opened for any kind of traffic until the State Government or an Inspector empowered by the State Government in this behalf has, by an order, sanctioned the opening thereof for that purpose. Such sanction shall not be given until rules for the safe and efficient working of the aerial ropeway have been duly made under section 45 and an Inspector has, after inspection of the aerial ropeway, reported in writing to the State Government- (a) that he has made a careful inspection of the aerial ropeway and appurtenances; (b) that the moving and fixed dimensions and other conditions prescribed under sub-section (4) of section 9 and sub-section (1) of section 10 have been complied with; (c) that the aerial ropeway is sufficiently equipped for the traffic for which it is intended ; (d) that the aerial ropeway is in his opinion, fit for public traffic and can be used without danger either to the persons, animals or goods carried thereon, or to the persons employed thereon, or to the general public. (2) The provisions of sub-section (1) shall extend to the opening of additional sections of the aerial ropeway, and to deviation lines and any alteration or re-construction materially affecting the structural character of any work to which the provisions of sub-section (1) apply or are extended by this sub-section.
<span style="margin-left:15px;"></span>(<i>1</i>) No aerial ropeway shall be opened for any kind of traffic until the State Government or an Inspector empowered by the State Government in this behalf has, by an order, sanctioned the opening thereof for that purpose.
